Little Rex Ride on Car Hire Agreement
This Hire Agreement ("Agreement") is entered into by and between Little Rex Pty Ltd (ABN: 46 689 457 074) ("Little Rex" or "Service Provider") and you, the hirer ("Hirer").
WHEREAS, the Hirer seeks to engage Little Rex for the hire of ride-on cars and associated equipment for a specified period; and WHEREAS, Little Rex agrees to provide such equipment and services under the terms and conditions set forth in this Agreement.
NOW, THEREFORE, the Hirer acknowledges and agrees to the following terms and conditions:
001. DEFINITIONS

"Little Rex" refers to Little Rex Pty Ltd (ABN: 46 689 457 074) and its employees, agents, or contractors.

"Hirer" refers to the individual or entity hiring the equipment (must be 18 years or older).

"Contract" or "Agreement" means this hire agreement, including the invoice or quotation, these terms, any special terms, and other written communications.

"Equipment" means all ride on cars, vehicles, batteries, and associated items hired by Little Rex to the Hirer.

"Hire Period" or "Event/Party Date" means the duration for which the Equipment is hired, as specified in the invoice or agreed.

"Cost" means the hire fee (including any damage/booking deposit), as specified in the invoice or agreed.

"Site" means the location where the Equipment is delivered or set up.
002. PAYMENT TERMS
Little Rex is not obligated to deliver or provide possession of the Equipment until the Cost is paid in full and funds are cleared.
Quoted and invoiced amounts exclude third-party costs unless explicitly stated.
Payment schedules are as follows (applicable to Private Parties):
A) A non-refundable $150.00 deposit via bank transfer is required upon acceptance of the hire date check, invoice or quotation to secure the booking.
B) Full payment (100%) via bank transfer is due 14 days prior to the Hire Period or Event/Party Date.
C) Alternatively, full payment (100%) via credit card can be paid at the time of booking (online only).
Payment schedules are as follows (applicable to Community, School and Daycare Events):
A) A non-refundable 25% deposit via bank transfer or credit card is required upon acceptance of the invoice or quotation to secure the booking.
B) Full payment (100%) via bank transfer or credit card is due 14 days prior to the Hire Period or Event/Party Date.
C) Alternatively, full payment (100%) via bank transfer or credit card can be paid at the time of booking.
003. CANCELLATION, EARLY RETURNS, AND UNUSED EQUIPMENT
No refunds will be issued for unused consumables, Equipment, or early return of Equipment before the Hire Period ends.
Cancellations after booking confirmation are subject to:
A) More than 14 days prior to the Hire Period or Event/Party Date: A full credit will be issued for rebooking within 12 months (less any non-refundable deposit where applicable).
B) Less than 14 days prior: A 50% credit will be issued, with forfeiture of 50% of the Cost.
C) Cancellation on the Hire Date: Forfeiture of the full Cost.
If the Hirer cancels, the booking deposit will generally be retained, with any additional payments handled per the above credit policy.
Bookings made without confirmed date availability: If the date is unavailable, a credit (less any non-refundable portions) will be issued for use within 12 months. Credits are issued at Little Rex’s discretion and are not provided for changes of mind, booking errors, circumstances beyond Little Rex’s control, breaches of this Agreement, or actions that harm Little Rex’s reputation, staff, or contractors.
004. WET OR DANGEROUS WEATHER CONDITIONS
Little Rex will not operate Equipment in wet (including wet ground) or dangerous weather conditions for safety reasons. The Hirer must have an alternative plan (especially for outdoor events).
Weather-related cancellations:
A) If wet or dangerous weather is forecast 48 hours prior: A full credit will be issued for rebooking within 12 months.
B) If forecast 48 hours prior and the Hirer proceeds anyway, the standard cancellation policy applies if Little Rex deems it unsafe.
C) If unpredicted wet or dangerous weather occurs on the Hire Date: A full credit (less any non-refundable deposit where applicable) will be issued for use within 12 months .
Little Rex reserves the right to modify or cancel the booking on the day due to weather or other factors beyond our control. In such cases, we will endeavour to accommodate the situation, but if cancellation occurs and no alternative arrangements were made by the Hirer, the deposit may be retained and the balance handled as a credit or partial refund at our discretion. No further compensation will be offered.
005. VENUE AND ACCESS
The Hirer is responsible for ensuring the venue and access are suitable and safe for delivery and operation of the Equipment. Little Rex reserves the right to refuse delivery if the venue or access is deemed unsuitable or unsafe upon arrival. No refund will be provided in this case. Venue and access requirements are accepted by the Hirer at the time of booking.
006. LICENSING AND PERMITS
The Hirer is solely responsible for obtaining all necessary licenses, permits, or approvals. The Hirer is liable for any legal repercussions from failure to do so, and Little Rex may seek compensation for any resulting fees, losses, or damages.
007. EQUIPMENT USE AND RESPONSIBILITY
Little Rex staff will provide comprehensive instructions and a digital/manual safety briefing on safe operation at the start of the Hire Period.
The Hirer agrees to the following obligations:

No food, drink, or water is to be used on or near the cars and Equipment.

The vehicles will be delivered fully charged and should last an average of 2-2.5 hours. If the battery runs out, do not attempt to charge them yourself or allow the children to push the cars.

Children must be supervised by a responsible adult at all times. Parents/guardians are responsible for the safety of the children during the hire period.

Only children under the age of 8 (or under 120cm tall) are permitted to use the vehicles.

Children must be seated and one child per vehicles while using them.
The Hirer is responsible for protecting and using the Equipment correctly during the Hire Period (unless Little Rex staff remain on-site for the full duration (community events)). The Hirer shall compensate Little Rex for the full replacement cost of any Equipment that is damaged, lost, stolen, or requires excessive cleaning during the Hire Period (excluding fair wear and tear), plus any related financial loss or expense.
The Hirer must not remove, relocate, alter, repair, or use the Equipment for any purpose other than specified. Little Rex’s identification, trade name, trademark, or signage must not be concealed or removed.
008. GOODS FOUND OR KEPT IN POSSESSION
Any goods owned by the Hirer found in the Equipment upon collection may be disposed of by Little Rex unless claimed within 14 days. Any Little Rex property found by the Hirer must be reported and returned promptly.
009. TERMINATION OF AGREEMENT
Little Rex may terminate this Agreement at any time without liability. If terminated before the Event/Party Date, payments (excluding the non-refundable deposit) will be refunded or credited. If terminated after the event commences, the Hirer must return all Equipment immediately upon notice. Little Rex may enter the Site to retrieve the Equipment at the Hirer’s expense. Failure to allow access will result in the Equipment being deemed stolen, reported to authorities, and the Hirer liable for all recovery costs, losses, and legal fees.
010. LIABILITY
Little Rex provides the services with reasonable skill and care. We accept liability for our own negligence only to the extent outlined here. Nothing limits liability for death or personal injury caused by negligence, or as required by law. Neither party shall be liable for indirect or consequential loss. Little Rex does not assume any implied obligations beyond those explicitly stated. Little Rex shall not be responsible for breaches resulting from force majeure events (including extreme weather, natural disasters, government actions, etc.).
011. MODIFICATIONS TO TERMS
Little Rex reserves the right to modify these terms without notice to ensure compliance with company values, insurance, licensing, permits, and applicable laws.
012. GOVERNING LAW
This Agreement is governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the Queensland courts.
By engaging the services of Little Rex Pty Ltd (ABN: 46 689 457 074) through booking or payment, the Hirer acknowledges and agrees to be bound by these terms and conditions, as provided in the contract documents and online at https://www.littlerex.com.au/car-hire/hire-agreement
