By using our service, or allowing your kids to use our service, including but not limited to 12v Kids Cars (Ride on Cars) and associated equipment, you are agreeing to this Liability Waiver ("Waiver") by and between Little Rex Pty Ltd. (ABN: 46 689 457 074) ("Service Provider") and you, the Hirer ("Hirer", "Renter", "Parent" and/or "Legal Guardian")
I, the hirer, renter, parent or legal guardian of the child and children in my care who will be using the 12v Kids Cars (Ride on Cars) and associated equipment provided by Little Rex Pty Ltd., acknowledge the following terms and conditions:
001. ACKNOWLEDGEMENT OF RISK:
I, understand that engaging in activities involving electric 12v Kids Cars (Ride on Cars) and associated equipment carries inherent risks of minor injuries such as bumps, bruises and scratches. I also understand that while Little Rex Pty Ltd., takes all necessary precautions to ensure the safety of the equipment, it is impossible to eliminate all risks.
002. SUPERVISIONS:
I, agree to always provide adequate supervision to my child and children in my care while they are using the Ride on Cars and/or associated equipment to minimize the risk of injury to them and others.
003. INSTRUCTION:
I, agree that I have received adequate instruction in the safe operation and handling of the Ride on Cars and associated equipment and understand my responsibilities related to the safe use of them.
004. RELEASE OF LIABILITY:
I, hereby release, waive, discharge and covenant not to sue Little Rex Pty Ltd., It’s owners, employees, agents, and other representatives from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of related to any loss, damage, or injury, including but not limited to personal injury or property damage, that may be sustained by my child, children in my care, my guests or myself as a result of using the Ride on Cars or associated equipment, or participating in any activities related to them.
005. INDEMNIFICATION:
I, agree to indemnify and hold harmless Little Rex Pty Ltd., its owners, employees, agents, and other representatives from any and all claims, actions, damages, liabilities, costs and expenses, including but not limited to attorney fees, arising out of or related to my child and children in my care use of the Ride on Cars or associated equipment or my failure to supervise them adequately.
006. EMERGENCY CONTACT:
In the event of an emergency, I, understand that Little Rex Pty Ltd. May not be present and therefore cannot provide direct assistance. However, I agree to provide information and be in contact with Little Rex Pty Ltd. relating to any and all issues or injuries related to my rental/hire or use of 12v Kids Cars (Ride on Cars) and associated equipment
007. OTHER TERMS NOT LISTED:
I, agree that I have read and understood the full ‘Little Rex Pty Ltd. Hire Agreement’ as listed on https://www.littlerex.com.au/car-hire/hire-agreement (Little Rex website).
008. GOVERNING LAW
This Agreement is governed by the laws of Queensland, Australia, and any disputes shall be subject to the exclusive jurisdiction of Queensland courts.
009. DELIVERY AND RESPONSIBILITY
The Renter confirms that the ride on cars and associated equipment listed below were delivered in full and agrees to remain responsible for the equipment until the end of the hire period.
